What is Massport’s Policy Statement in regards to Diversity & Inclusion/Compliance? (expand)

It is the policy of Massport to ensure that DBEs, M/WBEs, and ACDBEs have an equal opportunity to receive and participate in all Massport contracts. It is also Massport’s policy:

  • To ensure nondiscrimination in the award and administration of all contracts;
  • To create a level playing field on which DBEs, M/WBEs, and ACDBEs can compete fairly for all Massport contracts;
  • To ensure that the DBE, M/WBE, ACDBE Program is narrowly tailored in accordance with the Regulations and other applicable laws;
  • To ensure that only firms that fully meet the Commonwealth of Massachusetts and Federal eligibility standards are permitted to participate as DBEs, M/WBEs, and ACDBEs;
  • To help remove barriers to the participation of DBEs, M/WBEs, and ACDBEs in all Massport contracts;
  • To promote the use of DBEs, M/WBEs, and ACDBEs in all types of non-federal and federal-assisted contracts and procurement activities;
  • To assist the development of firms that can compete successfully in the market place outside the DBE, M/WBE, and ACDBE Program; and
  • To provide appropriate flexibility to Massport in establishing and providing opportunities for DBEs, M/WBEs, and ACDBEs.

 

What is the definition of Minority Business Enterprise? (expand)

A Minority Business Enterprise (MBE) is defined as a for-profit small business in which more than 51% of the interest, stock and otherwise, is owned by minority group members:

  • African American
  • Asian-Indian American
  • Asian-Pacific American
  • Hispanic American
  • Native American

What is the definition of a Women Business Enterprise? (expand)

A Women Business Enterprise is a women-owned for-profit small business that is (a) at least fifty-one percent (51%) percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and (b) whose management and daily business operations are controlled by one or more women

What is the definition of a Disadvantaged Business Enterprise (DBE)? (expand)

A Disadvantaged Business Enterprise (DBE) is a for profit small business where socially and economically disadvantaged individuals own at least a 51% interest and also control management and daily business operations. African Americans, Hispanics, Native Americans, Asian-Pacific and Subcontinent Asian Americans, and Women are presumed to be socially and economically disadvantaged. Other individuals can also qualify as socially and economically disadvantaged on a case-by-case basis.

What is the definition of an Airport Concession Disadvantaged Business Enterprise (ACDBE)? (expand)

An Airport Concession Disadvantaged Business Enterprise (ACDBE) a concession that is a for-profit, small business (a) that is at least fifty-one percent (51%) owned by one or more individuals who are both socially and economically disadvantaged or, in the case of a corporation, in which fifty-one percent (51%) of the stock is owned by one or more socially and economically disadvantaged individuals; and (b) whose management and daily business operations are controlled by one or more of the socially and economically disadvantaged individuals who own it.

What is the definition of a Concession? (expand)

Concession means one or more of the types of for-profit businesses listed in paragraph (1) or (2) of this definition:

(1) A business, located on an airport subject to this part, that is engaged in the sale of consumer goods or services to the public under an agreement with the recipient, another concessionaire, or the owner or lessee of a terminal, if other than the recipient.

(2) A business conducting one or more of the following covered activities, even if it does not maintain an office, store, or other business location on an airport subject to this part, as long as the activities take place on the airport: Management contracts and subcontracts, a web-based or other electronic business in a terminal or which passengers can access at the terminal, an advertising business that provides advertising displays or messages to the public on the airport, or a business that provides goods and services to concessionaires.

 

I have WBE or MBE Certification why do I need to obtain DBE certification? (expand)

To participate in business opportunities with federally funded contracts by Federal Aviation Administration (FAA), you must apply for DBE Certification. If you wish to qualify for DBE status please contact the Massachusetts Supplier Diversity Office to request information on the DBE Certification Process.

Once certified, can an ACDBE, WBE, MBE or DBE be assured of getting a contract or opportunity at Massport? (expand)

While certification does not guarantee that an ACDBE, WBE, MBE, and or DBE will win a contract or opportunity, it does enhance their exposure to prime contractors and the business community. To be successful in winning business, a firm must market themselves as any business would.

What are MPA’s workforce utilization requirements? (expand)

Office of Federal Contract Compliance Programs (OFCCP) administers and enforces Executive Order 11246, which prohibits contractors and subcontractors, who do over $10,000 in Government business in one year from discriminating in employment decisions on the basis of race, color, religion, sex, or national origin.

The Executive Order also requires Government contractors to take affirmative action to insure that equal opportunity is provided in all aspects of their employment.

The utilization of minorities and women shall be, at a minimum, that currently in use by the federal government. This requirement stated at 41 C.F.R. parts 60-4 is 6.9% utilization of women and 10%percent utilization of minorities, as a percent of work hours.
